1. Provider and scope

These Terms and Conditions (“Terms”) apply to all contracts between Alpha International Software Development LLC, A. Mitskevich str. #29, 0194 Tbilisi, Georgia, e-mail info@m-byte.com (“we”, “us”) and our customers (“you”) regarding the website m-byte.com, the M-BYTE desktop software, the customer account, subscriptions and credits (together the “Service”).

They apply to business customers and to consumers. Where a rule only applies to consumers or only to business customers, this is stated. Deviating terms of the customer do not apply.

The English version is binding. Translations are provided for convenience.

2. Conclusion of the contract and customer account

To use the Service you must register a customer account with true and complete data (name, billing address, e-mail) and confirm your e-mail address. You must be at least 18 years old. You must keep your login data and licence key secret.

The presentation of plans and credit packages is not a binding offer. By clicking the purchase button you make a binding offer; the contract is concluded when the payment has been completed successfully. You receive the confirmation, invoice, download link and licence key by e-mail.

Before every purchase you must accept these Terms. Your acceptance is recorded with date, time, IP address and version of the Terms.

3. The Service

M-BYTE is Windows software that analyses an original ECU or TCU file read out by you, detects the control unit and shows which solutions are available automatically from our solution database (e.g. Stage 1/2, TCU tuning, DPF, EGR, AdBlue, other options, DTC off). The files are processed on our servers; an internet connection is required.

Only the solutions shown in the app as available for your file are owed. We do not guarantee that a solution exists for every vehicle, control unit or software version. The database is extended continuously; there is no claim to a particular extension.

We aim for high availability, but interruptions for maintenance, updates or reasons beyond our control may occur. There is no claim to uninterrupted availability.

4. Subscriptions

The current plans, prices and included features are shown on m-byte.com and in the customer account at the time of the order. Subscriptions run monthly or yearly and are paid in advance by card via Bank of Georgia.

A subscription renews automatically for the same period at the same price unless you cancel it. You can cancel at any time in your customer account; the cancellation takes effect at the end of the current period. Paid periods are not refunded, not even partially.

If a renewal payment fails, the subscription remains usable for a short grace period; afterwards access is suspended until payment is made.

We may change prices for future periods. We inform you at least 30 days before the change takes effect; you may cancel before that date.

5. Credits

Stage and TCU tuning files are paid for with credits (“CR”). Prices: 1 CR = €10; a tuning file costs 2 CR for cars and 3 CR for trucks, agricultural, construction and other vehicles. The prices valid at the time of the purchase are shown in the app before the download.

Options and DTC off are included in the subscription and do not cost credits. Within the same file, options combined with a stage are included in the price of the tuning file.

Credits are deducted only when the tuned file has been created successfully. Downloading the same file again is free of charge.

Credits can only be used with an active subscription. They are bound to your account, not transferable and cannot be paid out. They remain valid as long as your customer account exists.

6. No refund after payment

Subscriptions and credits are digital content and digital services that are made available to you immediately after payment. All payments are final – there is no refund after payment, neither for subscriptions (including unused periods or unused daily limits) nor for credits (used or unused) nor for files created.

Mandatory statutory rights remain unaffected, in particular in case of a double charge or if we are unable to provide the paid Service at all for reasons for which we are responsible.

7. Right of withdrawal for consumers

If you are a consumer, you generally have a statutory right to withdraw from a contract concluded at a distance within 14 days.

The right of withdrawal expires for digital content and digital services if we begin performance after you have (1) expressly requested and agreed that we begin immediately, before the end of the withdrawal period, and (2) confirmed that you are aware that you thereby lose your right of withdrawal. With every purchase you give this request and confirmation; access to the subscription and credit balance is granted immediately after payment.

Business customers have no right of withdrawal.

8. Daily limits and fair use

Stage and TCU tuning files are not limited per day; each is paid with credits. Files with options and/or DTC off only are limited to the number of option files per day stated in your plan (currently 10). One file counts once, however many options it contains. The limits reset every day at midnight.

Mass or automated downloads, systematically “collecting” versions of a file and any use that is not related to vehicles you actually work on are prohibited.

9. Requests for missing solutions

If no automatic solution is available, you can send a request free of charge from the app. Processing a request (ticket) takes up to 24 hours. There is no claim that a solution can be created in every case. When the solution has been added you are informed; you then load your original file again and get the file in the app as usual (tuning files with credits).

10. Map editor, A2L and map packs

The map editor is free to view and edit. Maps are only shown with your own A2L file or an M-BYTE map pack for the software of your file. When you save an edited file as a new version, the price shown in the app (currently 2 credits) is charged once per software version after your confirmation; further saves for the same software version are free. If the A2L does not match or no map pack exists, nothing is charged.

Your A2L file is read on your computer only and is not uploaded. By using a matching A2L you agree that M-BYTE stores only the important maps derived from it (position, size, conversion and unit – with M-BYTE’s own names, without the names and texts of the A2L) as a map pack for this software version and offers it to other customers. Only use A2L files that you are entitled to use.

Changes made in the map editor are your own responsibility. We give no warranty that edited files work correctly or are permitted for road use; checksums are corrected by your flash tool when writing.

11. Licence and prohibited actions

You receive a simple, non-exclusive, non-transferable licence to use the software on one computer for the duration of your subscription. The software, the solution database and all content remain our property or that of our licensors.

Prohibited are in particular: passing on, selling or sharing the licence key or account; using the app via remote access software (e.g. TeamViewer, AnyDesk) – remote access is detected; decompiling, modifying, cracking or circumventing the software or its licence and limit checks; reselling files created with M-BYTE or the solution database to third parties.

In case of a violation we may suspend or block the licence immediately (see “Suspension and termination”).

12. Lawful use and responsibility

Modifications of engine and transmission control units, in particular DPF, EGR, AdBlue/SCR, NOx, lambda, DTC off and performance increases, may affect emissions, type approval, registration, insurance and warranty.

You alone are responsible for the lawful use of the files, for compliance with all laws in your country and for informing your end customers. You must always keep a backup of the original file, check every file before writing it and have the professional knowledge and suitable tools for reading and writing control units.

13. Your confirmation: legal consequences

By accepting these Terms you confirm that you are aware of the legal, technical and insurance consequences of modifying engine and transmission control units – in particular for registration, type approval and operating permit, emission and roadworthiness inspections, insurance cover, manufacturer warranty, as well as wear and service life of engine and drivetrain – and that you bear these consequences alone.

You also confirm this separately with a checkbox at registration and with every purchase. The confirmation is stored together with the version of these Terms.

14. No guarantee of function

Files created with M-BYTE (solutions from the database, files changed in the map editor, files from requests) are provided “as is”. We give no guarantee or warranty that a file works in a particular vehicle, achieves a certain performance or behaves without faults. Whether a file is suitable for a vehicle depends among other things on the hardware, software version, condition of the vehicle and the tools used, which we do not know and cannot check.

Check every file before writing it, keep the original file and use files at your own risk.

15. Liability

The Service is provided “as is”. We are not liable for damage to engines, transmissions, control units or vehicles, for loss of registration, type approval, insurance or warranty, for fines or legal consequences, or for the use of files by third parties.

In all other respects our liability is limited to the amount you paid to us in the 12 months before the damaging event. These limitations do not apply to damage caused intentionally or by gross negligence, to injury to life, body or health, or where liability is mandatory by law.

You indemnify us against all claims of third parties resulting from your unlawful use of the Service.

16. Suspension and termination

We may suspend or terminate your account without notice in case of a breach of these Terms (e.g. key sharing, remote access, collecting, fraud, chargebacks, unlawful use). In this case paid fees and credits are not refunded.

You can terminate your account at any time by contacting us; running subscriptions should be cancelled in the account first. Remaining credits expire with the deletion of the account.

17. Prices, invoices and taxes

All prices are in euros and are final prices. Alpha International Software Development LLC is a company in Georgia; invoices are issued electronically without VAT and are available in the customer account. You are responsible for any taxes, import VAT or reverse-charge obligations in your country.

18. Privacy policy

We process: account and billing data (name, address, e-mail), licence key, computer ID and number of computers, IP address and the country derived from it, log-in and activity log (e.g. uploads, downloads, purchases, requests), information on remote access software running on the computer, uploaded original files and created files, credit and payment history, and messages to our support.

Purposes: providing the Service and the licence, billing, preventing misuse (key sharing, remote access, fake accounts), security and support. Legal bases are the performance of the contract, legal obligations and our legitimate interest in protecting the Service.

Retention: uploaded files are deleted automatically after about 2 days unless they are part of a request; the activity log is kept for up to 12 months; unconfirmed registrations are deleted after a few days; invoices are kept as required by law; account data until the account is deleted.

Recipients: Bank of Georgia (payments – we never see or store your card data), our hosting provider (Hetzner, Germany), Cloudflare (network protection and delivery) and our e-mail provider. We do not sell personal data.

Cookies: only technically necessary cookies (log-in session, security). No tracking or advertising cookies are used in the customer area or app.

You have the right to access, rectification, erasure, restriction, data portability and objection, and the right to complain to a supervisory authority. Contact: info@m-byte.com.

19. Changes to these Terms

We may change these Terms for the future. We inform you by e-mail or in the customer account. For running subscriptions the new Terms apply from the next renewal; if you do not agree you can cancel before. You accept the current version with every purchase.

20. Governing law, jurisdiction and final provisions

The law of Georgia applies. For consumers, mandatory consumer protection provisions of the country of their habitual residence remain unaffected. For business customers the place of jurisdiction is Tbilisi, Georgia.

Should individual provisions be invalid, the validity of the remaining provisions is not affected.

1. Anbieter und Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen („AGB“) gelten für alle Verträge zwischen der Alpha International Software Development LLC, A. Mitskevich str. #29, 0194 Tbilisi, Georgia, E-Mail info@m-byte.com („wir“) und unseren Kunden („du“) über die Website m-byte.com, die Desktop-Software M-BYTE, das Kundenkonto, Abos und Credits (zusammen der „Dienst“).

Sie gelten für Unternehmer und Verbraucher. Gilt eine Regel nur für Verbraucher oder nur für Unternehmer, ist das angegeben. Abweichende Bedingungen des Kunden gelten nicht.

Verbindlich ist die englische Fassung; Übersetzungen dienen der Information.

2. Vertragsschluss und Kundenkonto

Für die Nutzung musst du ein Kundenkonto mit wahren und vollständigen Angaben (Name, Rechnungsadresse, E-Mail) anlegen und deine E-Mail-Adresse bestätigen. Du musst mindestens 18 Jahre alt sein. Zugangsdaten und Lizenzschlüssel sind geheim zu halten.

Die Darstellung der Pläne und Credit-Pakete ist kein bindendes Angebot. Mit Klick auf den Kauf-Button gibst du ein verbindliches Angebot ab; der Vertrag kommt mit erfolgreichem Abschluss der Zahlung zustande. Bestätigung, Rechnung, Download-Link und Lizenzschlüssel erhältst du per E-Mail.

Vor jedem Kauf musst du diese AGB akzeptieren. Die Zustimmung wird mit Datum, Uhrzeit, IP-Adresse und AGB-Version gespeichert.

3. Der Dienst

M-BYTE ist eine Windows-Software, die eine von dir ausgelesene Originaldatei eines Motor- oder Getriebesteuergeräts analysiert, das Steuergerät erkennt und anzeigt, welche Lösungen aus unserer Lösungsdatenbank automatisch verfügbar sind (z. B. Stage 1/2, TCU-Tuning, DPF, EGR, AdBlue, weitere Optionen, DTC off). Die Dateien werden auf unseren Servern verarbeitet; eine Internetverbindung ist erforderlich.

Geschuldet sind nur die Lösungen, die in der App für deine Datei als verfügbar angezeigt werden. Wir garantieren nicht, dass es für jedes Fahrzeug, Steuergerät oder jede Softwareversion eine Lösung gibt. Die Datenbank wird laufend erweitert; ein Anspruch auf eine bestimmte Erweiterung besteht nicht.

Wir streben eine hohe Verfügbarkeit an; Unterbrechungen durch Wartung, Updates oder Ursachen außerhalb unseres Einflusses sind möglich. Ein Anspruch auf ununterbrochene Verfügbarkeit besteht nicht.

4. Abos

Die aktuellen Pläne, Preise und Leistungen sind zum Zeitpunkt der Bestellung auf m-byte.com und im Kundenkonto angegeben. Abos laufen monatlich oder jährlich und werden im Voraus per Karte über die Bank of Georgia bezahlt.

Ein Abo verlängert sich automatisch um dieselbe Laufzeit zum gleichen Preis, wenn du es nicht kündigst. Du kannst jederzeit im Kundenkonto kündigen; die Kündigung wirkt zum Ende der laufenden Periode. Bezahlte Zeiträume werden nicht, auch nicht anteilig, erstattet.

Schlägt eine Verlängerungszahlung fehl, bleibt das Abo für eine kurze Nachfrist nutzbar; danach wird der Zugang bis zur Zahlung gesperrt.

Wir dürfen die Preise für künftige Laufzeiten ändern. Wir informieren dich mindestens 30 Tage vor Wirksamwerden; du kannst bis dahin kündigen.

5. Credits

Stage- und TCU-Tuning-Dateien werden mit Credits („CR“) bezahlt. Preise: 1 CR = 10 €; eine Tuning-Datei kostet 2 CR für PKW und 3 CR für LKW, Land-, Baumaschinen und sonstige Fahrzeuge. Der jeweils gültige Preis wird in der App vor dem Download angezeigt.

Optionen und DTC off sind im Abo enthalten und kosten keine Credits. Optionen in derselben Datei wie eine Stage sind im Preis der Tuning-Datei enthalten.

Credits werden erst abgebucht, wenn die getunte Datei erfolgreich erstellt wurde. Dieselbe Datei erneut herunterzuladen ist kostenlos.

Credits können nur mit aktivem Abo verwendet werden. Sie sind an dein Konto gebunden, nicht übertragbar und werden nicht ausgezahlt. Sie bleiben gültig, solange dein Kundenkonto besteht.

6. Keine Rückerstattung nach Bezahlung

Abos und Credits sind digitale Inhalte und digitale Dienstleistungen, die dir sofort nach der Zahlung bereitgestellt werden. Alle Zahlungen sind endgültig – nach der Bezahlung gibt es keine Rückerstattung, weder für Abos (auch nicht für nicht genutzte Zeiträume oder Tageslimits) noch für Credits (genutzt oder ungenutzt) noch für erstellte Dateien.

Zwingende gesetzliche Rechte bleiben unberührt, insbesondere bei einer doppelten Belastung oder wenn wir den bezahlten Dienst aus von uns zu vertretenden Gründen überhaupt nicht erbringen können.

7. Widerrufsrecht für Verbraucher

Als Verbraucher hast du grundsätzlich ein gesetzliches Recht, einen im Fernabsatz geschlossenen Vertrag binnen 14 Tagen zu widerrufen.

Das Widerrufsrecht erlischt bei digitalen Inhalten und digitalen Dienstleistungen, wenn wir mit der Ausführung beginnen, nachdem du (1) ausdrücklich zugestimmt hast, dass wir vor Ablauf der Widerrufsfrist sofort beginnen, und (2) bestätigt hast, dass du weißt, dass du dadurch dein Widerrufsrecht verlierst. Diese Zustimmung und Bestätigung gibst du bei jedem Kauf ab; Abo und Credit-Guthaben werden sofort nach der Zahlung freigeschaltet.

Unternehmer haben kein Widerrufsrecht.

8. Tageslimits und faire Nutzung

Stage- und TCU-Tuning-Dateien sind pro Tag nicht begrenzt; jede wird mit Credits bezahlt. Dateien nur mit Optionen und/oder DTC off sind auf die im Plan genannte Anzahl Options-Dateien pro Tag begrenzt (derzeit 10). Eine Datei zählt einmal, egal wie viele Optionen. Die Limits starten jeden Tag um Mitternacht neu.

Massen- oder automatisierte Downloads, das systematische „Sammeln“ von Dateiversionen und jede Nutzung ohne Bezug zu tatsächlich von dir bearbeiteten Fahrzeugen sind verboten.

9. Anfragen für fehlende Lösungen

Gibt es keine automatische Lösung, kannst du aus der App kostenlos eine Anfrage senden. Die Bearbeitung einer Anfrage (Ticket) dauert bis zu 24 Stunden. Ein Anspruch darauf, dass in jedem Fall eine Lösung erstellt werden kann, besteht nicht. Ist die Lösung ergänzt, wirst du informiert; du lädst dann deine Originaldatei erneut und erhältst die Datei wie gewohnt in der App (Tuning-Dateien mit Credits).

10. Map-Editor, A2L und Mappacks

Ansehen und Bearbeiten im Map-Editor sind kostenlos. Kennfelder werden nur mit deiner eigenen A2L-Datei oder einem M-BYTE-Mappack für die Software deiner Datei angezeigt. Beim Speichern einer bearbeiteten Datei als neue Version wird der in der App angezeigte Preis (derzeit 2 Credits) nach deiner Bestätigung einmal pro Software-Version abgebucht; weitere Speicherungen für dieselbe Software-Version sind kostenlos. Passt die A2L nicht oder gibt es kein Mappack, wird nichts verrechnet.

Deine A2L-Datei wird nur auf deinem Rechner gelesen und nicht hochgeladen. Mit der Verwendung einer passenden A2L stimmst du zu, dass M-BYTE nur die daraus abgeleiteten wichtigen Kennfelder (Lage, Größe, Umrechnung und Einheit – mit eigenen M-BYTE-Bezeichnungen, ohne die Namen und Texte der A2L) als Mappack für diese Software-Version speichert und anderen Kunden anbietet. Verwende nur A2L-Dateien, zu deren Nutzung du berechtigt bist.

Änderungen im Map-Editor erfolgen auf eigene Verantwortung. Wir übernehmen keine Gewähr, dass bearbeitete Dateien fehlerfrei funktionieren oder für den Straßenverkehr zulässig sind; Prüfsummen korrigiert dein Flash-Tool beim Schreiben.

11. Lizenz und verbotene Handlungen

Du erhältst ein einfaches, nicht ausschließliches, nicht übertragbares Recht, die Software für die Dauer deines Abos auf einem Computer zu nutzen. Software, Lösungsdatenbank und alle Inhalte bleiben unser Eigentum bzw. das unserer Lizenzgeber.

Verboten ist insbesondere: Lizenzschlüssel oder Konto weiterzugeben, zu verkaufen oder zu teilen; die App über Fernzugriffs-Software (z. B. TeamViewer, AnyDesk) zu nutzen – Fernzugriff wird erkannt; die Software oder ihre Lizenz- und Limitprüfung zu dekompilieren, zu verändern, zu cracken oder zu umgehen; mit M-BYTE erstellte Dateien oder die Lösungsdatenbank an Dritte weiterzuverkaufen.

Bei einem Verstoß dürfen wir die Lizenz sofort sperren (siehe „Sperre und Kündigung“).

12. Rechtmäßige Nutzung und Verantwortung

Änderungen an Motor- und Getriebesteuergeräten, insbesondere DPF, EGR, AdBlue/SCR, NOx, Lambda, DTC off und Leistungssteigerungen, können Abgasverhalten, Typgenehmigung, Zulassung, Versicherung und Garantie beeinflussen.

Du allein bist für die rechtmäßige Verwendung der Dateien, die Einhaltung aller Gesetze in deinem Land und die Information deiner Endkunden verantwortlich. Du musst stets eine Sicherung der Originaldatei aufbewahren, jede Datei vor dem Schreiben prüfen und über das Fachwissen und geeignete Werkzeuge zum Lesen und Schreiben von Steuergeräten verfügen.

13. Deine Bestätigung: rechtliche Folgen

Mit der Annahme dieser AGB bestätigst du, dass dir die rechtlichen, technischen und versicherungsrechtlichen Folgen von Änderungen an Motor- und Getriebesteuergeräten bewusst sind – insbesondere für Zulassung, Typgenehmigung und Betriebserlaubnis, Abgas- und Hauptuntersuchungen, Versicherungsschutz, Herstellergarantie sowie Verschleiß und Lebensdauer von Motor und Antriebsstrang – und dass du diese Folgen allein trägst.

Das bestätigst du zusätzlich mit einer eigenen Checkbox bei der Registrierung und bei jedem Kauf. Die Bestätigung wird mit der Version dieser AGB gespeichert.

14. Keine Garantie auf Funktion

Mit M-BYTE erstellte Dateien (Lösungen aus der Datenbank, im Map-Editor geänderte Dateien, Dateien aus Anfragen) werden „wie besehen“ bereitgestellt. Wir übernehmen keine Garantie oder Gewähr dafür, dass eine Datei in einem bestimmten Fahrzeug funktioniert, eine bestimmte Leistung erreicht oder fehlerfrei läuft. Ob eine Datei zu einem Fahrzeug passt, hängt unter anderem von Hardware, Softwarestand, Zustand des Fahrzeugs und den verwendeten Werkzeugen ab, die wir nicht kennen und nicht prüfen können.

Prüfe jede Datei vor dem Schreiben, bewahre die Originaldatei auf und verwende Dateien auf eigenes Risiko.

15. Haftung

Der Dienst wird „wie besehen“ bereitgestellt. Wir haften nicht für Schäden an Motoren, Getrieben, Steuergeräten oder Fahrzeugen, für den Verlust von Zulassung, Typgenehmigung, Versicherungsschutz oder Garantie, für Bußgelder oder rechtliche Folgen oder für die Verwendung von Dateien durch Dritte.

Im Übrigen ist unsere Haftung auf den Betrag begrenzt, den du in den 12 Monaten vor dem schädigenden Ereignis an uns bezahlt hast. Diese Beschränkungen gelten nicht bei Vorsatz und grober Fahrlässigkeit, bei Verletzung von Leben, Körper oder Gesundheit und soweit eine Haftung gesetzlich zwingend ist.

Du stellst uns von allen Ansprüchen Dritter frei, die aus deiner rechtswidrigen Nutzung des Dienstes entstehen.

16. Sperre und Kündigung

Wir dürfen dein Konto bei einem Verstoß gegen diese AGB (z. B. Weitergabe des Schlüssels, Fernzugriff, Sammeln, Betrug, Rückbuchungen, rechtswidrige Nutzung) ohne Vorankündigung sperren oder kündigen. Bezahlte Entgelte und Credits werden in diesem Fall nicht erstattet.

Du kannst dein Konto jederzeit über uns löschen lassen; laufende Abos solltest du vorher im Konto kündigen. Restliche Credits verfallen mit der Löschung des Kontos.

17. Preise, Rechnungen und Steuern

Alle Preise sind in Euro und Endpreise. Die Alpha International Software Development LLC ist ein Unternehmen in Georgien; Rechnungen werden elektronisch ohne Mehrwertsteuer ausgestellt und stehen im Kundenkonto bereit. Für Steuern, Einfuhrumsatzsteuer oder Reverse-Charge-Pflichten in deinem Land bist du selbst verantwortlich.

18. Datenschutz

Verantwortlicher: Alpha International Software Development LLC, A. Mitskevich str. #29, 0194 Tbilisi, Georgia, info@m-byte.com.

Wir verarbeiten: Konto- und Rechnungsdaten (Name, Adresse, E-Mail), Lizenzschlüssel, Computer-ID und Anzahl der Computer, IP-Adresse und das daraus ermittelte Land, Anmelde- und Aktivitätsprotokoll (z. B. Uploads, Downloads, Käufe, Anfragen), Angaben zu auf dem Computer laufender Fernzugriffs-Software, hochgeladene Originaldateien und erstellte Dateien, Credit- und Zahlungsverlauf sowie Nachrichten an unseren Support.

Zwecke: Bereitstellung von Dienst und Lizenz, Abrechnung, Verhinderung von Missbrauch (Weitergabe von Schlüsseln, Fernzugriff, Fake-Konten), Sicherheit und Support. Rechtsgrundlagen sind die Vertragserfüllung, gesetzliche Pflichten und unser berechtigtes Interesse am Schutz des Dienstes.

Wir dürfen diese AGB für die Zukunft ändern. Wir informieren dich per E-Mail oder im Kundenkonto. Für laufende Abos gelten neue AGB ab der nächsten Verlängerung; bist du nicht einverstanden, kannst du vorher kündigen. Mit jedem Kauf akzeptierst du die aktuelle Fassung.

20. Anwendbares Recht, Gerichtsstand und Schlussbestimmungen

Es gilt georgisches Recht. Für Verbraucher bleiben zwingende Verbraucherschutzvorschriften des Landes ihres gewöhnlichen Aufenthalts unberührt. Gerichtsstand für Unternehmer ist Tiflis, Georgien.

Sollten einzelne Bestimmungen unwirksam sein, bleibt die Wirksamkeit der übrigen unberührt.

1. Prestataire et champ d’application

Les présentes conditions générales (« CGV ») s’appliquent à tous les contrats entre Alpha International Software Development LLC, A. Mitskevich str. #29, 0194 Tbilisi, Georgia, e-mail info@m-byte.com (« nous ») et nos clients (« vous ») concernant le site m-byte.com, le logiciel M-BYTE, le compte client, les abonnements et les crédits (ensemble le « Service »).

Elles s’appliquent aux professionnels et aux consommateurs. Lorsqu’une règle ne vaut que pour l’un ou l’autre, cela est indiqué. Les conditions divergentes du client ne s’appliquent pas.

Seule la version anglaise fait foi ; les traductions sont fournies à titre informatif.

2. Conclusion du contrat et compte client

Pour utiliser le Service, vous devez créer un compte client avec des données exactes et complètes (nom, adresse de facturation, e-mail) et confirmer votre adresse e-mail. Vous devez avoir au moins 18 ans. Vos identifiants et votre clé de licence doivent rester secrets.

La présentation des offres et des packs de crédits ne constitue pas une offre ferme. En cliquant sur le bouton d’achat, vous faites une offre ferme ; le contrat est conclu lorsque le paiement a abouti. Vous recevez par e-mail la confirmation, la facture, le lien de téléchargement et la clé de licence.

Avant chaque achat, vous devez accepter les présentes CGV. Votre acceptation est enregistrée avec la date, l’heure, l’adresse IP et la version des CGV.

3. Le Service

M-BYTE est un logiciel Windows qui analyse un fichier d’origine de calculateur moteur ou de boîte lu par vous, identifie le calculateur et indique quelles solutions sont disponibles automatiquement dans notre base (p. ex. Stage 1/2, reprogrammation TCU, FAP, EGR, AdBlue, autres options, DTC off). Les fichiers sont traités sur nos serveurs ; une connexion Internet est nécessaire.

Seules les solutions affichées dans l’application comme disponibles pour votre fichier sont dues. Nous ne garantissons pas l’existence d’une solution pour chaque véhicule, calculateur ou version de logiciel. La base est étendue en continu, sans droit à une extension particulière.

Nous visons une haute disponibilité ; des interruptions pour maintenance, mises à jour ou causes indépendantes de notre volonté restent possibles, sans droit à une disponibilité ininterrompue.

4. Abonnements

Les offres, prix et prestations en vigueur sont indiqués sur m-byte.com et dans le compte client au moment de la commande. Les abonnements sont mensuels ou annuels et payés d’avance par carte via Bank of Georgia.

L’abonnement est renouvelé automatiquement pour la même durée au même prix, sauf résiliation. Vous pouvez résilier à tout moment dans votre compte ; la résiliation prend effet à la fin de la période en cours. Les périodes payées ne sont pas remboursées, même partiellement.

En cas d’échec du paiement de renouvellement, l’abonnement reste utilisable pendant un court délai de grâce ; l’accès est ensuite suspendu jusqu’au paiement.

Nous pouvons modifier les prix pour les périodes futures. Nous vous en informons au moins 30 jours à l’avance ; vous pouvez résilier avant cette date.

5. Crédits

Les fichiers stage et TCU se paient en crédits (« CR »). Prix : 1 CR = 10 € ; un fichier stage coûte 2 CR pour les voitures et 3 CR pour les camions, machines agricoles, de chantier et autres véhicules. Le prix en vigueur est affiché dans l’application avant le téléchargement.

Les options et le DTC off sont inclus dans l’abonnement et ne coûtent pas de crédits. Les options dans le même fichier qu’un stage sont comprises dans le prix du fichier stage.

Les crédits ne sont débités que lorsque le fichier modifié a été créé avec succès. Retélécharger le même fichier est gratuit.

Les crédits ne peuvent être utilisés qu’avec un abonnement actif. Ils sont liés à votre compte, non transférables et non remboursables en espèces. Ils restent valables tant que votre compte client existe.

6. Aucun remboursement après paiement

Les abonnements et crédits sont des contenus et services numériques mis à votre disposition immédiatement après le paiement. Tous les paiements sont définitifs – aucun remboursement n’est possible après paiement, ni pour les abonnements (y compris périodes ou limites journalières non utilisées), ni pour les crédits (utilisés ou non), ni pour les fichiers créés.

Les droits légaux impératifs restent réservés, notamment en cas de double débit ou si nous ne pouvons pas du tout fournir le Service payé pour des raisons qui nous sont imputables.

7. Droit de rétractation des consommateurs

Si vous êtes consommateur, vous disposez en principe d’un droit légal de rétractation de 14 jours pour un contrat conclu à distance.

Le droit de rétractation s’éteint pour les contenus et services numériques lorsque nous commençons l’exécution après que vous avez (1) expressément demandé et accepté que nous commencions immédiatement, avant la fin du délai de rétractation, et (2) reconnu que vous perdez ainsi votre droit de rétractation. Vous donnez cette demande et cette reconnaissance à chaque achat ; l’abonnement et le solde de crédits sont activés immédiatement après le paiement.

Les professionnels ne disposent pas d’un droit de rétractation.

8. Limites journalières et usage loyal

Les fichiers stage et TCU ne sont pas limités par jour ; chacun est payé en crédits. Les fichiers contenant uniquement des options et/ou le DTC off sont limités au nombre de fichiers options par jour indiqué dans votre offre (actuellement 10). Un fichier compte une fois, quel que soit le nombre d’options. Les limites repartent à zéro chaque jour à minuit.

Les téléchargements massifs ou automatisés, la « collecte » systématique de versions d’un fichier et toute utilisation sans lien avec des véhicules sur lesquels vous travaillez réellement sont interdits.

9. Demandes de solutions manquantes

Si aucune solution automatique n’existe, vous pouvez envoyer gratuitement une demande depuis l’application. Le traitement d’une demande (ticket) prend jusqu’à 24 heures. Il n’existe aucun droit à ce qu’une solution puisse être créée dans tous les cas. Lorsque la solution est ajoutée, vous êtes informé ; vous rechargez alors votre fichier d’origine et obtenez le fichier dans l’application comme d’habitude (fichiers stage en crédits).

10. Éditeur de cartographies, A2L et map packs

Consulter et modifier dans l’éditeur de cartographies est gratuit. Les cartographies ne sont affichées qu’avec votre propre fichier A2L ou un map pack M-BYTE pour le logiciel de votre fichier. Lorsque vous enregistrez un fichier modifié comme nouvelle version, le prix affiché dans l’application (actuellement 2 crédits) est débité une fois par version logicielle après votre confirmation ; les enregistrements suivants pour la même version logicielle sont gratuits. Si l’A2L ne correspond pas ou s’il n’existe pas de map pack, rien n’est débité.

Votre fichier A2L est lu uniquement sur votre ordinateur et n’est pas envoyé. En utilisant une A2L correspondante, vous acceptez que M-BYTE conserve uniquement les cartographies importantes qui en sont dérivées (position, taille, conversion et unité – avec ses propres noms, sans les noms et textes de l’A2L) comme map pack pour cette version logicielle et le propose à d’autres clients. N’utilisez que des fichiers A2L que vous êtes autorisé à utiliser.

Les modifications effectuées dans l’éditeur sont sous votre responsabilité. Nous ne garantissons pas que les fichiers modifiés fonctionnent correctement ou soient autorisés sur la voie publique ; les sommes de contrôle sont corrigées par votre outil lors de l’écriture.

11. Licence et actes interdits

Vous recevez un droit simple, non exclusif et non transférable d’utiliser le logiciel sur un ordinateur pendant la durée de votre abonnement. Le logiciel, la base de solutions et tous les contenus restent notre propriété ou celle de nos concédants.

Sont notamment interdits : transmettre, vendre ou partager la clé de licence ou le compte ; utiliser l’application via un logiciel d’accès à distance (p. ex. TeamViewer, AnyDesk) – l’accès à distance est détecté ; décompiler, modifier, cracker ou contourner le logiciel ou ses contrôles de licence et de limites ; revendre à des tiers des fichiers créés avec M-BYTE ou la base de solutions.

En cas de violation, nous pouvons suspendre ou bloquer immédiatement la licence (voir « Suspension et résiliation »).

12. Utilisation licite et responsabilité

Les modifications des calculateurs moteur et de boîte, notamment FAP, EGR, AdBlue/SCR, NOx, lambda, DTC off et augmentations de puissance, peuvent affecter les émissions, l’homologation, l’immatriculation, l’assurance et la garantie.

Vous êtes seul responsable de l’utilisation licite des fichiers, du respect de toutes les lois de votre pays et de l’information de vos clients finaux. Vous devez toujours conserver une sauvegarde du fichier d’origine, vérifier chaque fichier avant écriture et disposer des connaissances et outils adaptés.

13. Votre confirmation : conséquences juridiques

En acceptant ces Conditions, vous confirmez avoir conscience des conséquences juridiques, techniques et d’assurance des modifications des calculateurs moteur et de boîte – notamment pour l’immatriculation, l’homologation et l’autorisation de circuler, les contrôles antipollution et techniques, la couverture d’assurance, la garantie constructeur ainsi que l’usure et la durée de vie du moteur et de la transmission – et que vous assumez seul ces conséquences.

Vous le confirmez en outre par une case à cocher distincte lors de l’inscription et de chaque achat. La confirmation est enregistrée avec la version de ces Conditions.

14. Aucune garantie de fonctionnement

Les fichiers créés avec M-BYTE (solutions de la base de données, fichiers modifiés dans l’éditeur, fichiers issus de demandes) sont fournis « en l’état ». Nous ne donnons aucune garantie qu’un fichier fonctionne dans un véhicule donné, atteigne une certaine puissance ou fonctionne sans défaut. L’adéquation d’un fichier dépend notamment du matériel, de la version logicielle, de l’état du véhicule et des outils utilisés, que nous ne connaissons pas et ne pouvons pas vérifier.

Vérifiez chaque fichier avant écriture, conservez le fichier d’origine et utilisez les fichiers à vos propres risques.

15. Responsabilité

Le Service est fourni « en l’état ». Nous ne sommes pas responsables des dommages aux moteurs, boîtes, calculateurs ou véhicules, de la perte d’immatriculation, d’homologation, d’assurance ou de garantie, des amendes ou conséquences juridiques, ni de l’utilisation des fichiers par des tiers.

Pour le reste, notre responsabilité est limitée au montant que vous nous avez payé au cours des 12 mois précédant le fait dommageable. Ces limitations ne s’appliquent pas en cas de faute intentionnelle ou lourde, d’atteinte à la vie, au corps ou à la santé, ni lorsque la responsabilité est impérative en vertu de la loi.

Vous nous garantissez contre toute réclamation de tiers résultant de votre utilisation illicite du Service.

16. Suspension et résiliation

Nous pouvons suspendre ou résilier votre compte sans préavis en cas de violation des présentes CGV (p. ex. partage de clé, accès à distance, collecte, fraude, rétrofacturations, usage illicite). Les sommes et crédits payés ne sont alors pas remboursés.

Vous pouvez faire supprimer votre compte à tout moment en nous contactant ; résiliez d’abord les abonnements en cours dans le compte. Les crédits restants expirent avec la suppression du compte.

17. Prix, factures et taxes

Tous les prix sont en euros et sont des prix finaux. Alpha International Software Development LLC est une société géorgienne ; les factures sont émises électroniquement sans TVA et disponibles dans le compte client. Vous êtes responsable des taxes, TVA à l’importation ou obligations d’autoliquidation dans votre pays.

18. Politique de confidentialité

Nous traitons : données de compte et de facturation (nom, adresse, e-mail), clé de licence, identifiant et nombre d’ordinateurs, adresse IP et pays qui en découle, journal de connexion et d’activité (p. ex. envois, téléchargements, achats, demandes), informations sur les logiciels d’accès à distance actifs sur l’ordinateur, fichiers d’origine envoyés et fichiers créés, historique des crédits et paiements, messages à notre support.

Finalités : fourniture du Service et de la licence, facturation, prévention des abus (partage de clé, accès à distance, faux comptes), sécurité et support. Bases juridiques : exécution du contrat, obligations légales et notre intérêt légitime à protéger le Service.

Conservation : les fichiers envoyés sont supprimés automatiquement après environ 2 jours sauf s’ils font partie d’une demande ; le journal d’activité jusqu’à 12 mois ; les inscriptions non confirmées après quelques jours ; les factures selon les obligations légales ; les données de compte jusqu’à la suppression du compte.

Destinataires : Bank of Georgia (paiements – nous ne voyons ni ne conservons vos données de carte), notre hébergeur (Hetzner, Allemagne), Cloudflare (protection réseau et diffusion) et notre fournisseur d’e-mail. Nous ne vendons pas de données personnelles.

Cookies : uniquement des cookies techniquement nécessaires (session, sécurité). Aucun cookie de suivi ou publicitaire dans l’espace client ou l’application.

Vous disposez des droits d’accès, de rectification, d’effacement, de limitation, de portabilité et d’opposition, ainsi que du droit d’introduire une réclamation auprès d’une autorité de contrôle. Contact : info@m-byte.com.

19. Modification des CGV

Nous pouvons modifier les présentes CGV pour l’avenir. Nous vous en informons par e-mail ou dans le compte client. Pour les abonnements en cours, les nouvelles CGV s’appliquent à partir du prochain renouvellement ; si vous n’êtes pas d’accord, vous pouvez résilier avant. Vous acceptez la version en vigueur à chaque achat.

20. Droit applicable, juridiction et dispositions finales

Le droit géorgien s’applique. Pour les consommateurs, les dispositions impératives de protection du pays de leur résidence habituelle restent applicables. Pour les professionnels, la juridiction compétente est Tbilissi, Géorgie.

Si certaines dispositions sont invalides, la validité des autres n’en est pas affectée.

2. Conclusione del contratto e account cliente

Per utilizzare il Servizio devi registrare un account cliente con dati veritieri e completi (nome, indirizzo di fatturazione, e-mail) e confermare il tuo indirizzo e-mail. Devi avere almeno 18 anni. Devi mantenere segreti i tuoi dati di accesso e la chiave di licenza.

La presentazione dei piani e dei pacchetti di crediti non costituisce un'offerta vincolante. Cliccando sul pulsante di acquisto formuli un'offerta vincolante; il contratto si conclude quando il pagamento è stato completato con successo. Ricevi via e-mail la conferma, la fattura, il link di download e la chiave di licenza.

3. Il Servizio

M-BYTE è un software Windows che analizza un file originale ECU o TCU da te letto, riconosce la centralina e mostra quali soluzioni sono disponibili automaticamente dal nostro database di soluzioni (ad es. Stage 1/2, rimappatura TCU, DPF, EGR, AdBlue, altre opzioni, DTC off). I file vengono elaborati sui nostri server; è necessaria una connessione a internet.

Sono dovute solo le soluzioni mostrate nell'app come disponibili per il tuo file. Non garantiamo che esista una soluzione per ogni veicolo, centralina o versione software. Il database viene ampliato continuamente; non sussiste alcun diritto a un determinato ampliamento.

Puntiamo a un'elevata disponibilità, ma possono verificarsi interruzioni per manutenzione, aggiornamenti o cause al di fuori del nostro controllo. Non sussiste alcun diritto a una disponibilità ininterrotta.

4. Abbonamenti

Un abbonamento si rinnova automaticamente per lo stesso periodo allo stesso prezzo, salvo disdetta. Puoi disdire in qualsiasi momento nel tuo account cliente; la disdetta ha effetto alla fine del periodo in corso. I periodi pagati non vengono rimborsati, nemmeno parzialmente.

I crediti vengono scalati solo quando il file elaborato è stato creato con successo. Riscaricare lo stesso file è gratuito.

I crediti possono essere utilizzati solo con un abbonamento attivo. Sono legati al tuo account, non sono trasferibili e non possono essere convertiti in denaro. Restano validi finché esiste il tuo account cliente.

6. Nessun rimborso dopo il pagamento

Gli abbonamenti e i crediti sono contenuti digitali e servizi digitali che ti vengono messi a disposizione immediatamente dopo il pagamento. Tutti i pagamenti sono definitivi – non è previsto alcun rimborso dopo il pagamento, né per gli abbonamenti (inclusi periodi non utilizzati o limiti giornalieri non utilizzati), né per i crediti (utilizzati o non utilizzati), né per i file creati.

Restano impregiudicati i diritti di legge inderogabili, in particolare in caso di doppio addebito o se non siamo in grado di fornire affatto il Servizio pagato per motivi a noi imputabili.

7. Diritto di recesso per i consumatori

Se sei un consumatore, hai in linea di principio il diritto legale di recedere entro 14 giorni da un contratto concluso a distanza.

Il diritto di recesso si estingue per i contenuti digitali e i servizi digitali se iniziamo l'esecuzione dopo che tu (1) hai espressamente richiesto e acconsentito che iniziamo immediatamente, prima della scadenza del periodo di recesso, e (2) hai confermato di essere consapevole che in tal modo perdi il tuo diritto di recesso. Con ogni acquisto fornisci questa richiesta e questa conferma; l'accesso all'abbonamento e al saldo crediti viene concesso immediatamente dopo il pagamento.

I clienti business non hanno diritto di recesso.

8. Limiti giornalieri e uso corretto

I file di tuning Stage e TCU non sono limitati per giorno; ciascuno si paga con crediti. I file con sole opzioni e/o DTC off sono limitati al numero di file opzioni al giorno indicato nel tuo piano (attualmente 10). Un file conta una sola volta, indipendentemente da quante opzioni contiene. I limiti si azzerano ogni giorno a mezzanotte.

Sono vietati i download di massa o automatizzati, la “raccolta” sistematica di versioni di un file e qualsiasi utilizzo non legato a veicoli su cui lavori effettivamente.

9. Richieste per soluzioni mancanti

Se non è disponibile alcuna soluzione automatica, puoi inviare gratuitamente una richiesta dall'app. L'elaborazione di una richiesta (ticket) richiede fino a 24 ore. Non sussiste alcun diritto a che una soluzione possa essere creata in ogni caso. Quando la soluzione è stata aggiunta vieni informato; ricarichi quindi il tuo file originale e ottieni il file nell'app come sempre (file di tuning con crediti).

10. Editor mappe, A2L e map pack

La visualizzazione e la modifica nell'editor mappe sono gratuite. Le mappe vengono mostrate solo con il tuo file A2L o con un map pack M-BYTE per il software del tuo file. Quando salvi un file modificato come nuova versione, il prezzo mostrato nell'app (attualmente 2 crediti) viene addebitato una sola volta per versione software dopo la tua conferma; i salvataggi successivi per la stessa versione software sono gratuiti. Se la A2L non corrisponde o non esiste un map pack, non viene addebitato nulla.

Il tuo file A2L viene letto solo sul tuo computer e non viene caricato. Utilizzando una A2L corrispondente acconsenti che M-BYTE memorizzi solo le mappe importanti da essa derivate (posizione, dimensione, conversione e unità – con nomi propri di M-BYTE, senza i nomi e i testi della A2L) come map pack per questa versione software e lo offra ad altri clienti. Utilizza solo file A2L che hai il diritto di usare.

Le modifiche effettuate nell'editor mappe sono sotto la tua responsabilità. Non forniamo alcuna garanzia che i file modificati funzionino correttamente o siano ammessi alla circolazione stradale; i checksum vengono corretti dal tuo strumento di flash durante la scrittura.

11. Licenza e azioni vietate

Ricevi una licenza semplice, non esclusiva e non trasferibile per utilizzare il software su un computer per la durata del tuo abbonamento. Il software, il database di soluzioni e tutti i contenuti restano di nostra proprietà o di quella dei nostri licenzianti.

Sono vietati in particolare: cedere, vendere o condividere la chiave di licenza o l'account; utilizzare l'app tramite software di accesso remoto (ad es. TeamViewer, AnyDesk) – l'accesso remoto viene rilevato; decompilare, modificare, craccare o aggirare il software o i suoi controlli di licenza e dei limiti; rivendere a terzi file creati con M-BYTE o il database di soluzioni.

In caso di violazione possiamo sospendere o bloccare immediatamente la licenza (vedi “Sospensione e risoluzione”).

12. Uso lecito e responsabilità

Le modifiche alle centraline motore e cambio, in particolare DPF, EGR, AdBlue/SCR, NOx, lambda, DTC off e aumenti di potenza, possono incidere su emissioni, omologazione, immatricolazione, assicurazione e garanzia.

Sei l'unico responsabile dell'uso lecito dei file, del rispetto di tutte le leggi del tuo paese e dell'informazione dei tuoi clienti finali. Devi sempre conservare una copia di backup del file originale, verificare ogni file prima di scriverlo e disporre delle competenze professionali e degli strumenti adeguati per leggere e scrivere le centraline.

13. La tua conferma: conseguenze legali

Accettando i presenti Termini confermi di essere consapevole delle conseguenze legali, tecniche e assicurative della modifica delle centraline motore e cambio – in particolare per immatricolazione, omologazione e autorizzazione alla circolazione, controlli delle emissioni e revisioni, copertura assicurativa, garanzia del costruttore, nonché usura e durata di motore e trasmissione – e di sopportare da solo tali conseguenze.

Lo confermi inoltre separatamente con una casella di spunta al momento della registrazione e a ogni acquisto. La conferma viene memorizzata insieme alla versione dei presenti Termini.

14. Nessuna garanzia di funzionamento

I file creati con M-BYTE (soluzioni dal database, file modificati nell'editor mappe, file da richieste) sono forniti “così come sono”. Non forniamo alcuna garanzia che un file funzioni su un determinato veicolo, raggiunga determinate prestazioni o si comporti senza difetti. L'idoneità di un file per un veicolo dipende, tra l'altro, dall'hardware, dalla versione software, dalle condizioni del veicolo e dagli strumenti utilizzati, che non conosciamo e non possiamo verificare.

Verifica ogni file prima di scriverlo, conserva il file originale e utilizza i file a tuo rischio.

15. Responsabilità

Il Servizio è fornito “così com'è”. Non rispondiamo di danni a motori, cambi, centraline o veicoli, della perdita di immatricolazione, omologazione, assicurazione o garanzia, di sanzioni o conseguenze legali, né dell'utilizzo dei file da parte di terzi.

Per il resto la nostra responsabilità è limitata all'importo che ci hai pagato nei 12 mesi precedenti l'evento dannoso. Tali limitazioni non si applicano ai danni causati con dolo o colpa grave, alle lesioni alla vita, all'integrità fisica o alla salute, né ai casi in cui la responsabilità è prevista inderogabilmente dalla legge.

Ci manlevi da tutte le pretese di terzi derivanti dal tuo utilizzo illecito del Servizio.

16. Sospensione e risoluzione

Possiamo sospendere o chiudere il tuo account senza preavviso in caso di violazione dei presenti Termini (ad es. condivisione della chiave, accesso remoto, raccolta di file, frode, chargeback, uso illecito). In tal caso i corrispettivi e i crediti pagati non vengono rimborsati.

Puoi chiudere il tuo account in qualsiasi momento contattandoci; gli abbonamenti in corso dovrebbero prima essere disdetti nell'account. I crediti residui decadono con la cancellazione dell'account.

17. Prezzi, fatture e imposte

Tutti i prezzi sono in euro e sono prezzi finali. Alpha International Software Development LLC è una società con sede in Georgia; le fatture vengono emesse elettronicamente senza IVA e sono disponibili nell'account cliente. Sei responsabile di eventuali imposte, IVA all'importazione od obblighi di inversione contabile (reverse charge) nel tuo paese.

18. Informativa sulla privacy

Cookie: solo cookie tecnicamente necessari (sessione di accesso, sicurezza). Nell'area clienti e nell'app non vengono utilizzati cookie di tracciamento o pubblicitari.

19. Modifiche ai presenti Termini

Possiamo modificare i presenti Termini per il futuro. Ti informiamo via e-mail o nell'account cliente. Per gli abbonamenti in corso i nuovi Termini si applicano dal rinnovo successivo; se non sei d'accordo puoi disdire prima. Con ogni acquisto accetti la versione attuale.

20. Legge applicabile, foro competente e disposizioni finali

Si applica la legge della Georgia. Per i consumatori restano impregiudicate le disposizioni inderogabili a tutela dei consumatori del paese di residenza abituale. Per i clienti business il foro competente è Tbilisi, Georgia.

Qualora singole disposizioni fossero invalide, la validità delle restanti disposizioni non ne è pregiudicata.

1. Proveedor y ámbito de aplicación

Estos Términos y Condiciones (“Términos”) se aplican a todos los contratos entre Alpha International Software Development LLC, A. Mitskevich str. #29, 0194 Tbilisi, Georgia, e-mail info@m-byte.com (“nosotros”) y nuestros clientes (“tú”) relativos al sitio web m-byte.com, el software de escritorio M-BYTE, la cuenta de cliente, las suscripciones y los créditos (en conjunto, el “Servicio”).

Se aplican a clientes empresariales y a consumidores. Cuando una norma solo se aplique a consumidores o solo a clientes empresariales, así se indica. No se aplican condiciones divergentes del cliente.

La versión en inglés es la vinculante. Las traducciones se facilitan por comodidad.

2. Celebración del contrato y cuenta de cliente

Para usar el Servicio debes registrar una cuenta de cliente con datos verdaderos y completos (nombre, dirección de facturación, e-mail) y confirmar tu dirección de e-mail. Debes tener al menos 18 años. Debes mantener en secreto tus datos de acceso y tu clave de licencia.

La presentación de los planes y paquetes de créditos no constituye una oferta vinculante. Al hacer clic en el botón de compra realizas una oferta vinculante; el contrato se celebra cuando el pago se ha completado correctamente. Recibes la confirmación, la factura, el enlace de descarga y la clave de licencia por e-mail.

Antes de cada compra debes aceptar estos Términos. Tu aceptación se registra con la fecha, la hora, la dirección IP y la versión de los Términos.

3. El Servicio

M-BYTE es un software para Windows que analiza un archivo original de ECU o TCU leído por ti, detecta la unidad de control y muestra qué soluciones están disponibles automáticamente en nuestra base de datos de soluciones (p. ej. Stage 1/2, reprogramación TCU, DPF, EGR, AdBlue, otras opciones, DTC off). Los archivos se procesan en nuestros servidores; se requiere conexión a internet.

Solo se deben las soluciones que la app muestra como disponibles para tu archivo. No garantizamos que exista una solución para cada vehículo, unidad de control o versión de software. La base de datos se amplía continuamente; no existe derecho a una ampliación determinada.

Aspiramos a una alta disponibilidad, pero pueden producirse interrupciones por mantenimiento, actualizaciones o motivos ajenos a nuestro control. No existe derecho a una disponibilidad ininterrumpida.

4. Suscripciones

Los planes, precios y funciones incluidas vigentes se muestran en m-byte.com y en la cuenta de cliente en el momento del pedido. Las suscripciones son mensuales o anuales y se pagan por adelantado con tarjeta a través de Bank of Georgia.

Una suscripción se renueva automáticamente por el mismo periodo al mismo precio, salvo que la canceles. Puedes cancelarla en cualquier momento en tu cuenta de cliente; la cancelación surte efecto al final del periodo en curso. Los periodos pagados no se reembolsan, ni siquiera parcialmente.

Si falla un pago de renovación, la suscripción sigue siendo utilizable durante un breve periodo de gracia; después, el acceso se suspende hasta que se realice el pago.

Podemos modificar los precios para periodos futuros. Te informaremos al menos 30 días antes de que el cambio surta efecto; puedes cancelar antes de esa fecha.

5. Créditos

Los archivos tuning de Stage y TCU se pagan con créditos (“CR”). Precios: 1 CR = 10 €; un archivo tuning cuesta 2 CR para turismos y 3 CR para camiones, maquinaria agrícola, de construcción y otros vehículos. Los precios vigentes en el momento de la compra se muestran en la app antes de la descarga.

Las opciones y DTC off están incluidos en la suscripción y no cuestan créditos. Dentro del mismo archivo, las opciones combinadas con un stage están incluidas en el precio del archivo tuning.

Los créditos solo se descuentan cuando el archivo modificado se ha creado correctamente. Volver a descargar el mismo archivo es gratuito.

Los créditos solo pueden usarse con una suscripción activa. Están vinculados a tu cuenta, no son transferibles y no pueden reembolsarse en efectivo. Siguen siendo válidos mientras exista tu cuenta de cliente.

6. Sin reembolso después del pago

Las suscripciones y los créditos son contenidos digitales y servicios digitales que se ponen a tu disposición inmediatamente después del pago. Todos los pagos son definitivos – no hay reembolso después del pago, ni para suscripciones (incluidos periodos no utilizados o límites diarios no utilizados), ni para créditos (utilizados o no), ni para archivos creados.

Los derechos legales imperativos no se ven afectados, en particular en caso de cargo duplicado o si no podemos prestar en absoluto el Servicio pagado por motivos imputables a nosotros.

7. Derecho de desistimiento para consumidores

Si eres consumidor, por lo general tienes el derecho legal de desistir de un contrato celebrado a distancia en un plazo de 14 días.

El derecho de desistimiento se extingue en el caso de contenidos digitales y servicios digitales si comenzamos la ejecución después de que tú (1) hayas solicitado y aceptado expresamente que comencemos de inmediato, antes de que finalice el plazo de desistimiento, y (2) hayas confirmado que eres consciente de que con ello pierdes tu derecho de desistimiento. Con cada compra das esta solicitud y confirmación; el acceso a la suscripción y al saldo de créditos se concede inmediatamente después del pago.

Los clientes empresariales no tienen derecho de desistimiento.

8. Límites diarios y uso razonable

Los archivos tuning de Stage y TCU no están limitados por día; cada uno se paga con créditos. Los archivos solo con opciones y/o DTC off están limitados al número de archivos de opciones por día indicado en tu plan (actualmente 10). Un archivo cuenta una vez, sin importar cuántas opciones contenga. Los límites se reinician cada día a medianoche.

Quedan prohibidas las descargas masivas o automatizadas, la “recopilación” sistemática de versiones de un archivo y cualquier uso que no esté relacionado con vehículos en los que trabajes realmente.

9. Solicitudes de soluciones que falten

Si no hay ninguna solución automática disponible, puedes enviar una solicitud gratuita desde la app. La tramitación de una solicitud (ticket) tarda hasta 24 horas. No existe derecho a que se pueda crear una solución en todos los casos. Cuando se haya añadido la solución, se te informará; entonces vuelves a cargar tu archivo original y obtienes el archivo en la app como siempre (archivos tuning con créditos).

10. Editor de mapas, A2L y paquetes de mapas

Ver y editar en el editor de mapas es gratuito. Los mapas solo se muestran con tu propio archivo A2L o con un paquete de mapas M-BYTE para el software de tu archivo. Cuando guardas un archivo editado como nueva versión, el precio mostrado en la app (actualmente 2 créditos) se cobra una vez por versión de software tras tu confirmación; los siguientes guardados para la misma versión de software son gratuitos. Si el A2L no coincide o no existe un paquete de mapas, no se cobra nada.

Tu archivo A2L solo se lee en tu ordenador y no se sube. Al usar un A2L compatible aceptas que M-BYTE almacene únicamente los mapas importantes derivados de él (posición, tamaño, conversión y unidad – con nombres propios de M-BYTE, sin los nombres ni textos del A2L) como paquete de mapas para esta versión de software y lo ofrezca a otros clientes. Utiliza solo archivos A2L que tengas derecho a usar.

Los cambios realizados en el editor de mapas son responsabilidad tuya. No damos ninguna garantía de que los archivos editados funcionen correctamente o estén permitidos para circular por vías públicas; las sumas de verificación (checksums) las corrige tu herramienta de flasheo al escribir.

11. Licencia y acciones prohibidas

Recibes una licencia simple, no exclusiva e intransferible para usar el software en un ordenador durante la vigencia de tu suscripción. El software, la base de datos de soluciones y todos los contenidos siguen siendo de nuestra propiedad o de la de nuestros licenciantes.

Están prohibidos en particular: ceder, vender o compartir la clave de licencia o la cuenta; usar la app mediante software de acceso remoto (p. ej. TeamViewer, AnyDesk) – el acceso remoto se detecta; descompilar, modificar, crackear o eludir el software o sus comprobaciones de licencia y de límites; revender a terceros archivos creados con M-BYTE o la base de datos de soluciones.

En caso de infracción podemos suspender o bloquear la licencia de inmediato (véase “Suspensión y rescisión”).

12. Uso legal y responsabilidad

Las modificaciones de las unidades de control de motor y de cambio, en particular DPF, EGR, AdBlue/SCR, NOx, sonda lambda, DTC off y aumentos de potencia, pueden afectar a las emisiones, la homologación de tipo, la matriculación, el seguro y la garantía.

Solo tú eres responsable del uso legal de los archivos, del cumplimiento de todas las leyes de tu país y de informar a tus clientes finales. Debes conservar siempre una copia de seguridad del archivo original, comprobar cada archivo antes de escribirlo y disponer de los conocimientos profesionales y las herramientas adecuadas para leer y escribir unidades de control.

13. Tu confirmación: consecuencias legales

Al aceptar estos Términos confirmas que eres consciente de las consecuencias legales, técnicas y relativas al seguro de modificar las unidades de control de motor y de cambio – en particular para la matriculación, la homologación de tipo y el permiso de circulación, las inspecciones de emisiones y técnicas (ITV), la cobertura del seguro, la garantía del fabricante, así como el desgaste y la vida útil del motor y de la cadena cinemática – y que asumes estas consecuencias tú solo.

También lo confirmas por separado mediante una casilla de verificación al registrarte y con cada compra. La confirmación se almacena junto con la versión de estos Términos.

14. Sin garantía de funcionamiento

Los archivos creados con M-BYTE (soluciones de la base de datos, archivos modificados en el editor de mapas, archivos procedentes de solicitudes) se proporcionan “tal cual”. No damos ninguna garantía de que un archivo funcione en un vehículo concreto, alcance una determinada potencia o funcione sin fallos. Que un archivo sea adecuado para un vehículo depende, entre otras cosas, del hardware, la versión de software, el estado del vehículo y las herramientas utilizadas, que no conocemos ni podemos comprobar.

Comprueba cada archivo antes de escribirlo, conserva el archivo original y utiliza los archivos bajo tu propia responsabilidad.

15. Responsabilidad

El Servicio se proporciona “tal cual”. No somos responsables de daños en motores, cambios, unidades de control o vehículos, de la pérdida de la matriculación, la homologación de tipo, el seguro o la garantía, de multas o consecuencias legales, ni del uso de archivos por parte de terceros.

En todo lo demás, nuestra responsabilidad se limita al importe que nos hayas pagado en los 12 meses anteriores al hecho causante del daño. Estas limitaciones no se aplican a daños causados de forma intencionada o por negligencia grave, a lesiones contra la vida, la integridad física o la salud, ni cuando la responsabilidad sea imperativa por ley.

Nos eximes de todas las reclamaciones de terceros derivadas de tu uso ilegal del Servicio.

16. Suspensión y rescisión

Podemos suspender o cancelar tu cuenta sin previo aviso en caso de incumplimiento de estos Términos (p. ej. compartir la clave, acceso remoto, recopilación, fraude, devoluciones de cargos, uso ilegal). En este caso, las tarifas pagadas y los créditos no se reembolsan.

Puedes dar de baja tu cuenta en cualquier momento contactando con nosotros; las suscripciones en curso deben cancelarse primero en la cuenta. Los créditos restantes caducan con la eliminación de la cuenta.

17. Precios, facturas e impuestos

Todos los precios están en euros y son precios finales. Alpha International Software Development LLC es una empresa de Georgia; las facturas se emiten electrónicamente sin IVA y están disponibles en la cuenta de cliente. Eres responsable de los impuestos, el IVA de importación o las obligaciones de inversión del sujeto pasivo (reverse charge) que correspondan en tu país.

18. Política de privacidad

Tratamos: datos de cuenta y de facturación (nombre, dirección, e-mail), clave de licencia, ID del ordenador y número de ordenadores, dirección IP y el país derivado de ella, registro de inicio de sesión y de actividad (p. ej. cargas, descargas, compras, solicitudes), información sobre software de acceso remoto en ejecución en el ordenador, archivos originales subidos y archivos creados, historial de créditos y pagos, y mensajes a nuestro soporte.

Finalidades: prestación del Servicio y de la licencia, facturación, prevención de abusos (compartir claves, acceso remoto, cuentas falsas), seguridad y soporte. Las bases jurídicas son la ejecución del contrato, las obligaciones legales y nuestro interés legítimo en proteger el Servicio.

Conservación: los archivos subidos se eliminan automáticamente al cabo de unos 2 días, salvo que formen parte de una solicitud; el registro de actividad se conserva hasta 12 meses; los registros no confirmados se eliminan a los pocos días; las facturas se conservan según exige la ley; los datos de la cuenta, hasta que se elimine la cuenta.

Destinatarios: Bank of Georgia (pagos – nunca vemos ni almacenamos los datos de tu tarjeta), nuestro proveedor de alojamiento (Hetzner, Alemania), Cloudflare (protección de red y entrega) y nuestro proveedor de e-mail. No vendemos datos personales.

Cookies: solo cookies técnicamente necesarias (sesión de inicio de sesión, seguridad). En el área de cliente y en la app no se utilizan cookies de seguimiento ni de publicidad.

Tienes derecho de acceso, rectificación, supresión, limitación, portabilidad de los datos y oposición, así como derecho a presentar una reclamación ante una autoridad de control. Contacto: info@m-byte.com.

19. Modificaciones de estos Términos

Podemos modificar estos Términos con efectos para el futuro. Te informaremos por e-mail o en la cuenta de cliente. Para las suscripciones en curso, los nuevos Términos se aplican a partir de la próxima renovación; si no estás de acuerdo, puedes cancelar antes. Con cada compra aceptas la versión vigente.

20. Ley aplicable, jurisdicción y disposiciones finales

Se aplica la legislación de Georgia. Para los consumidores, las disposiciones imperativas de protección del consumidor del país de su residencia habitual no se ven afectadas. Para los clientes empresariales, el fuero competente es Tiflis, Georgia.

Si alguna disposición fuera inválida, ello no afectará a la validez de las demás disposiciones.

2. Zawarcie umowy i konto klienta

Aby korzystać z Usługi, musisz zarejestrować konto klienta, podając prawdziwe i kompletne dane (imię i nazwisko, adres rozliczeniowy, e-mail), oraz potwierdzić swój adres e-mail. Musisz mieć ukończone co najmniej 18 lat. Musisz zachować w tajemnicy swoje dane logowania i klucz licencyjny.

Prezentacja planów i pakietów kredytów nie stanowi wiążącej oferty. Klikając przycisk zakupu, składasz wiążącą ofertę; umowa zostaje zawarta z chwilą pomyślnego zrealizowania płatności. Potwierdzenie, fakturę, link do pobrania i klucz licencyjny otrzymujesz e-mailem.

Przed każdym zakupem musisz zaakceptować niniejszy Regulamin. Twoja akceptacja jest rejestrowana wraz z datą, godziną, adresem IP i wersją Regulaminu.

3. Usługa

M-BYTE to oprogramowanie dla systemu Windows, które analizuje odczytany przez Ciebie oryginalny plik ECU lub TCU, rozpoznaje sterownik i pokazuje, które rozwiązania są automatycznie dostępne w naszej bazie rozwiązań (np. Stage 1/2, tuning TCU, DPF, EGR, AdBlue, inne opcje, DTC off). Pliki są przetwarzane na naszych serwerach; wymagane jest połączenie z internetem.

Zobowiązujemy się wyłącznie do dostarczenia rozwiązań, które w aplikacji są wyświetlane jako dostępne dla Twojego pliku. Nie gwarantujemy, że dla każdego pojazdu, sterownika lub wersji oprogramowania istnieje rozwiązanie. Baza danych jest stale rozbudowywana; nie przysługuje roszczenie o określone rozszerzenie.

Dążymy do wysokiej dostępności, jednak mogą wystąpić przerwy z powodu konserwacji, aktualizacji lub przyczyn od nas niezależnych. Nie przysługuje roszczenie o nieprzerwaną dostępność.

4. Abonamenty

Aktualne plany, ceny i zawarte w nich funkcje są przedstawione na m-byte.com oraz w koncie klienta w chwili składania zamówienia. Abonamenty są miesięczne lub roczne i opłacane z góry kartą za pośrednictwem Bank of Georgia.

Abonament odnawia się automatycznie na ten sam okres w tej samej cenie, chyba że go wypowiesz. Możesz go wypowiedzieć w dowolnym momencie w koncie klienta; wypowiedzenie staje się skuteczne z końcem bieżącego okresu. Opłacone okresy nie podlegają zwrotowi, nawet częściowemu.

Jeżeli płatność za odnowienie się nie powiedzie, abonament pozostaje dostępny przez krótki okres prolongaty; następnie dostęp zostaje zawieszony do czasu dokonania płatności.

Możemy zmieniać ceny na przyszłe okresy. Poinformujemy Cię co najmniej 30 dni przed wejściem zmiany w życie; możesz wypowiedzieć abonament przed tą datą.

5. Kredyty

Pliki tuningowe Stage i TCU są opłacane kredytami („CR”). Ceny: 1 CR = 10 €; plik tuningowy kosztuje 2 CR dla samochodów osobowych i 3 CR dla samochodów ciężarowych, maszyn rolniczych, budowlanych i innych pojazdów. Ceny obowiązujące w chwili zakupu są wyświetlane w aplikacji przed pobraniem.

Opcje i DTC off są zawarte w abonamencie i nie kosztują kredytów. W ramach tego samego pliku opcje połączone ze Stage są zawarte w cenie pliku tuningowego.

Kredyty są pobierane dopiero wtedy, gdy zmodyfikowany plik zostanie pomyślnie utworzony. Ponowne pobranie tego samego pliku jest bezpłatne.

Kredyty można wykorzystać wyłącznie przy aktywnym abonamencie. Są przypisane do Twojego konta, nie podlegają przeniesieniu ani wypłacie. Pozostają ważne tak długo, jak istnieje Twoje konto klienta.

6. Brak zwrotu po dokonaniu płatności

Abonamenty i kredyty są treściami cyfrowymi i usługami cyfrowymi, które są Ci udostępniane natychmiast po dokonaniu płatności. Wszystkie płatności są ostateczne – po dokonaniu płatności nie ma zwrotu, ani za abonamenty (w tym niewykorzystane okresy lub niewykorzystane limity dzienne), ani za kredyty (wykorzystane lub niewykorzystane), ani za utworzone pliki.

Bezwzględnie obowiązujące prawa ustawowe pozostają nienaruszone, w szczególności w przypadku podwójnego obciążenia lub gdy z przyczyn, za które ponosimy odpowiedzialność, w ogóle nie jesteśmy w stanie świadczyć opłaconej Usługi.

7. Prawo odstąpienia od umowy dla konsumentów

Jeżeli jesteś konsumentem, co do zasady przysługuje Ci ustawowe prawo odstąpienia od umowy zawartej na odległość w terminie 14 dni.

Prawo odstąpienia od umowy wygasa w przypadku treści cyfrowych i usług cyfrowych, jeżeli rozpoczniemy świadczenie po tym, jak (1) wyraźnie zażądałeś i zgodziłeś się, abyśmy rozpoczęli natychmiast, przed upływem terminu odstąpienia, oraz (2) potwierdziłeś, że wiesz, iż tym samym tracisz prawo odstąpienia od umowy. Przy każdym zakupie składasz to żądanie i potwierdzenie; dostęp do abonamentu i salda kredytów jest przyznawany natychmiast po dokonaniu płatności.

Klientom biznesowym nie przysługuje prawo odstąpienia od umowy.

8. Limity dzienne i uczciwe korzystanie

Pliki tuningowe Stage i TCU nie są ograniczone dziennie; każdy z nich jest opłacany kredytami. Pliki zawierające wyłącznie opcje i/lub DTC off są ograniczone do liczby plików z opcjami dziennie określonej w Twoim planie (obecnie 10). Każdy plik liczy się raz, niezależnie od liczby zawartych w nim opcji. Limity odnawiają się codziennie o północy.

Zabronione są masowe lub zautomatyzowane pobierania, systematyczne „zbieranie” wersji pliku oraz wszelkie korzystanie niezwiązane z pojazdami, nad którymi faktycznie pracujesz.

9. Zgłoszenia brakujących rozwiązań

Jeżeli automatyczne rozwiązanie nie jest dostępne, możesz bezpłatnie wysłać zgłoszenie z aplikacji. Rozpatrzenie zgłoszenia (ticketu) trwa do 24 godzin. Nie przysługuje roszczenie, że rozwiązanie da się utworzyć w każdym przypadku. Po dodaniu rozwiązania zostaniesz o tym poinformowany; następnie ponownie wczytujesz swój oryginalny plik i otrzymujesz plik w aplikacji jak zwykle (pliki tuningowe za kredyty).

10. Edytor map, A2L i pakiety map

Przeglądanie i edycja w edytorze map są bezpłatne. Mapy są wyświetlane wyłącznie z Twoim własnym plikiem A2L lub pakietem map M-BYTE dla oprogramowania Twojego pliku. Gdy zapisujesz edytowany plik jako nową wersję, cena wyświetlona w aplikacji (obecnie 2 kredyty) jest pobierana po Twoim potwierdzeniu jednorazowo za wersję oprogramowania; kolejne zapisy dla tej samej wersji oprogramowania są bezpłatne. Jeżeli plik A2L nie pasuje lub nie istnieje pakiet map, nic nie jest pobierane.

Twój plik A2L jest odczytywany wyłącznie na Twoim komputerze i nie jest przesyłany. Korzystając z pasującego pliku A2L, wyrażasz zgodę na to, aby M-BYTE zapisał wyłącznie wyprowadzone z niego najważniejsze mapy (położenie, rozmiar, przeliczenie i jednostkę – z własnymi nazwami M-BYTE, bez nazw i tekstów z A2L) jako pakiet map dla tej wersji oprogramowania i udostępniał go innym klientom. Używaj wyłącznie plików A2L, do których korzystania jesteś uprawniony.

Zmiany wprowadzane w edytorze map dokonujesz na własną odpowiedzialność. Nie udzielamy gwarancji, że edytowane pliki działają prawidłowo lub są dopuszczone do ruchu drogowego; sumy kontrolne są korygowane przez Twoje narzędzie do flashowania podczas zapisu.

11. Licencja i działania zabronione

Otrzymujesz zwykłą, niewyłączną, nieprzenoszalną licencję na korzystanie z oprogramowania na jednym komputerze przez okres trwania Twojego abonamentu. Oprogramowanie, baza rozwiązań i wszelkie treści pozostają naszą własnością lub własnością naszych licencjodawców.

Zabronione jest w szczególności: przekazywanie, sprzedawanie lub udostępnianie klucza licencyjnego lub konta; korzystanie z aplikacji za pomocą oprogramowania do zdalnego dostępu (np. TeamViewer, AnyDesk) – zdalny dostęp jest wykrywany; dekompilowanie, modyfikowanie, łamanie lub obchodzenie oprogramowania albo jego mechanizmów kontroli licencji i limitów; odsprzedawanie osobom trzecim plików utworzonych za pomocą M-BYTE lub bazy rozwiązań.

W przypadku naruszenia możemy natychmiast zawiesić lub zablokować licencję (zob. „Zawieszenie i rozwiązanie”).

12. Zgodne z prawem korzystanie i odpowiedzialność

Modyfikacje sterowników silnika i skrzyni biegów, w szczególności DPF, EGR, AdBlue/SCR, NOx, sonda lambda, DTC off i zwiększanie mocy, mogą wpływać na emisję spalin, homologację, rejestrację, ubezpieczenie i gwarancję.

Wyłącznie Ty ponosisz odpowiedzialność za zgodne z prawem wykorzystanie plików, za przestrzeganie wszystkich przepisów obowiązujących w Twoim kraju oraz za informowanie swoich klientów końcowych. Zawsze musisz przechowywać kopię zapasową oryginalnego pliku, sprawdzać każdy plik przed jego zapisaniem oraz posiadać wiedzę fachową i odpowiednie narzędzia do odczytu i zapisu sterowników.

13. Twoje potwierdzenie: skutki prawne

Akceptując niniejszy Regulamin, potwierdzasz, że jesteś świadomy prawnych, technicznych i ubezpieczeniowych skutków modyfikacji sterowników silnika i skrzyni biegów – w szczególności w zakresie rejestracji, homologacji i dopuszczenia do ruchu, badań emisji spalin i badań technicznych, ochrony ubezpieczeniowej, gwarancji producenta, a także zużycia i żywotności silnika i układu napędowego – oraz że ponosisz te skutki wyłącznie sam.

Potwierdzasz to również osobno, zaznaczając pole wyboru przy rejestracji i przy każdym zakupie. Potwierdzenie jest przechowywane wraz z wersją niniejszego Regulaminu.

14. Brak gwarancji działania

Pliki utworzone za pomocą M-BYTE (rozwiązania z bazy danych, pliki zmienione w edytorze map, pliki ze zgłoszeń) są udostępniane „w stanie, w jakim są”. Nie udzielamy żadnej gwarancji ani rękojmi, że plik będzie działał w określonym pojeździe, osiągnie określoną moc lub będzie działał bez usterek. To, czy plik jest odpowiedni dla danego pojazdu, zależy m.in. od sprzętu, wersji oprogramowania, stanu pojazdu i użytych narzędzi, których nie znamy i nie możemy sprawdzić.

Sprawdzaj każdy plik przed zapisaniem, przechowuj oryginalny plik i korzystaj z plików na własne ryzyko.

15. Odpowiedzialność

Usługa jest świadczona „w stanie, w jakim jest”. Nie ponosimy odpowiedzialności za uszkodzenia silników, skrzyń biegów, sterowników lub pojazdów, za utratę rejestracji, homologacji, ubezpieczenia lub gwarancji, za grzywny lub skutki prawne ani za wykorzystanie plików przez osoby trzecie.

W pozostałym zakresie nasza odpowiedzialność jest ograniczona do kwoty, którą zapłaciłeś nam w ciągu 12 miesięcy przed zdarzeniem wyrządzającym szkodę. Ograniczenia te nie mają zastosowania do szkód wyrządzonych umyślnie lub wskutek rażącego niedbalstwa, do szkód na życiu, ciele lub zdrowiu ani w przypadkach, gdy odpowiedzialność wynika z bezwzględnie obowiązujących przepisów prawa.

Zwalniasz nas z wszelkich roszczeń osób trzecich wynikających z Twojego niezgodnego z prawem korzystania z Usługi.

16. Zawieszenie i rozwiązanie

Możemy bez uprzedzenia zawiesić lub rozwiązać Twoje konto w przypadku naruszenia niniejszego Regulaminu (np. udostępniania klucza, zdalnego dostępu, zbierania plików, oszustwa, obciążeń zwrotnych, korzystania niezgodnego z prawem). W takim przypadku uiszczone opłaty i kredyty nie podlegają zwrotowi.

Możesz w dowolnym momencie rozwiązać swoje konto, kontaktując się z nami; trwające abonamenty należy najpierw wypowiedzieć w koncie. Pozostałe kredyty wygasają wraz z usunięciem konta.

17. Ceny, faktury i podatki

Wszystkie ceny są podane w euro i są cenami końcowymi. Alpha International Software Development LLC jest spółką z siedzibą w Gruzji; faktury są wystawiane elektronicznie bez VAT i są dostępne w koncie klienta. Odpowiadasz za wszelkie podatki, VAT od importu lub obowiązki w ramach odwrotnego obciążenia (reverse charge) w Twoim kraju.

Okres przechowywania: przesłane pliki są automatycznie usuwane po około 2 dniach, chyba że stanowią część zgłoszenia; dziennik aktywności jest przechowywany do 12 miesięcy; niepotwierdzone rejestracje są usuwane po kilku dniach; faktury są przechowywane zgodnie z wymogami prawa; dane konta do czasu usunięcia konta.

Odbiorcy: Bank of Georgia (płatności – nigdy nie widzimy ani nie przechowujemy danych Twojej karty), nasz dostawca hostingu (Hetzner, Niemcy), Cloudflare (ochrona sieci i dostarczanie treści) oraz nasz dostawca poczty e-mail. Nie sprzedajemy danych osobowych.

Pliki cookie: wyłącznie technicznie niezbędne pliki cookie (sesja logowania, bezpieczeństwo). W strefie klienta ani w aplikacji nie są używane pliki cookie śledzące ani reklamowe.

Przysługuje Ci prawo dostępu do danych, ich sprostowania, usunięcia, ograniczenia przetwarzania, przenoszenia danych i sprzeciwu, a także prawo wniesienia skargi do organu nadzorczego. Kontakt: info@m-byte.com.

19. Zmiany niniejszego Regulaminu

Możemy zmieniać niniejszy Regulamin na przyszłość. Informujemy Cię o tym e-mailem lub w koncie klienta. W przypadku trwających abonamentów nowy Regulamin obowiązuje od następnego odnowienia; jeżeli się nie zgadzasz, możesz wcześniej wypowiedzieć abonament. Przy każdym zakupie akceptujesz aktualną wersję.

20. Prawo właściwe, jurysdykcja i postanowienia końcowe

Obowiązuje prawo Gruzji. W przypadku konsumentów bezwzględnie obowiązujące przepisy o ochronie konsumentów kraju ich zwykłego pobytu pozostają nienaruszone. Dla klientów biznesowych sądem właściwym jest sąd w Tbilisi, w Gruzji.

Jeżeli poszczególne postanowienia okażą się nieważne, nie wpływa to na ważność pozostałych postanowień.

Bu Hüküm ve Koşullar (“Koşullar”), Alpha International Software Development LLC, A. Mitskevich str. #29, 0194 Tbilisi, Georgia, e-posta info@m-byte.com (“biz”) ile müşterilerimiz (“siz”) arasında m-byte.com web sitesi, M-BYTE masaüstü yazılımı, müşteri hesabı, abonelikler ve krediler (birlikte “Hizmet”) ile ilgili tüm sözleşmeler için geçerlidir.

2. Sözleşmenin kurulması ve müşteri hesabı

Hizmeti kullanmak için doğru ve eksiksiz bilgilerle (ad, fatura adresi, e-posta) bir müşteri hesabı oluşturmanız ve e-posta adresinizi onaylamanız gerekir. En az 18 yaşında olmalısınız. Giriş bilgilerinizi ve lisans anahtarınızı gizli tutmanız gerekir.

Paketlerin ve kredi paketlerinin sunulması bağlayıcı bir teklif değildir. Satın alma düğmesine tıklayarak bağlayıcı bir teklif vermiş olursunuz; sözleşme, ödeme başarıyla tamamlandığında kurulur. Onay, fatura, indirme bağlantısı ve lisans anahtarı size e-posta ile gönderilir.

Her satın alma işleminden önce bu Koşulları kabul etmeniz gerekir. Kabulünüz tarih, saat, IP adresi ve Koşulların sürümü ile birlikte kaydedilir.

3. Hizmet

M-BYTE, sizin tarafınızdan okunan orijinal bir ECU veya TCU dosyasını analiz eden, kontrol ünitesini tanıyan ve çözüm veritabanımızdan hangi çözümlerin otomatik olarak mevcut olduğunu (ör. Stage 1/2, TCU tuning, DPF, EGR, AdBlue, diğer opsiyonlar, DTC off) gösteren bir Windows yazılımıdır. Dosyalar sunucularımızda işlenir; internet bağlantısı gereklidir.

Yalnızca uygulamada dosyanız için mevcut olarak gösterilen çözümler borçlanılmıştır. Her araç, kontrol ünitesi veya yazılım sürümü için bir çözüm bulunacağını garanti etmeyiz. Veritabanı sürekli olarak genişletilir; belirli bir genişletmeye ilişkin herhangi bir hak talebi bulunmamaktadır.

Yüksek erişilebilirliği hedefleriz; ancak bakım, güncellemeler veya kontrolümüz dışındaki nedenlerle kesintiler yaşanabilir. Kesintisiz erişilebilirliğe ilişkin herhangi bir hak talebi bulunmamaktadır.

4. Abonelikler

Güncel paketler, fiyatlar ve dahil olan özellikler, sipariş anında m-byte.com’da ve müşteri hesabında gösterilir. Abonelikler aylık veya yıllık olarak çalışır ve Bank of Georgia aracılığıyla kartla peşin ödenir.

Bir abonelik, siz iptal etmediğiniz sürece aynı süre için aynı fiyattan otomatik olarak yenilenir. Müşteri hesabınızdan istediğiniz zaman iptal edebilirsiniz; iptal, mevcut dönemin sonunda geçerli olur. Ödenmiş dönemler, kısmen de olsa iade edilmez.

Bir yenileme ödemesi başarısız olursa, abonelik kısa bir ek süre boyunca kullanılabilir kalır; ardından erişim, ödeme yapılana kadar askıya alınır.

Gelecek dönemler için fiyatları değiştirebiliriz. Değişiklik yürürlüğe girmeden en az 30 gün önce sizi bilgilendiririz; bu tarihten önce iptal edebilirsiniz.

5. Krediler

Stage ve TCU tuning dosyaları kredi (“CR”) ile ödenir. Fiyatlar: 1 CR = 10 €; bir tuning dosyası binek araçlar için 2 CR, kamyonlar, tarım, iş makineleri ve diğer araçlar için 3 CR’dir. Satın alma anında geçerli fiyatlar, indirmeden önce uygulamada gösterilir.

Opsiyonlar ve DTC off aboneliğe dahildir ve kredi gerektirmez. Aynı dosya içinde bir stage ile birlikte seçilen opsiyonlar, tuning dosyasının fiyatına dahildir.

Krediler yalnızca tuning yapılmış dosya başarıyla oluşturulduğunda düşülür. Aynı dosyayı tekrar indirmek ücretsizdir.

Krediler yalnızca aktif bir abonelikle kullanılabilir. Hesabınıza bağlıdır, devredilemez ve nakit olarak ödenemez. Müşteri hesabınız var olduğu sürece geçerliliğini korur.

6. Ödemeden sonra iade yok

Abonelikler ve krediler, ödemeden hemen sonra kullanımınıza sunulan dijital içerik ve dijital hizmetlerdir. Tüm ödemeler kesindir – ödemeden sonra iade yapılmaz; ne abonelikler (kullanılmamış dönemler veya kullanılmamış günlük limitler dahil) ne krediler (kullanılmış veya kullanılmamış) ne de oluşturulan dosyalar için.

Emredici yasal haklar, özellikle mükerrer tahsilat durumunda veya ödenen Hizmeti sorumlu olduğumuz nedenlerle hiç sağlayamamamız halinde saklıdır.

7. Tüketiciler için cayma hakkı

Tüketiciyseniz, mesafeli olarak kurulan bir sözleşmeden 14 gün içinde cayma konusunda kural olarak yasal bir hakkınız vardır.

Cayma hakkı sona erer: dijital içerik ve dijital hizmetlerde, siz (1) cayma süresinin bitiminden önce hemen başlamamızı açıkça talep edip kabul ettikten ve (2) bu şekilde cayma hakkınızı kaybettiğinizin farkında olduğunuzu onayladıktan sonra ifaya başlamamız halinde. Her satın alma işleminde bu talebi ve onayı verirsiniz; aboneliğe ve kredi bakiyesine erişim ödemeden hemen sonra sağlanır.

Ticari müşterilerin cayma hakkı yoktur.

8. Günlük limitler ve adil kullanım

Stage ve TCU tuning dosyaları günlük olarak sınırlı değildir; her biri kredi ile ödenir. Yalnızca opsiyon ve/veya DTC off içeren dosyalar, paketinizde belirtilen günlük opsiyon dosyası sayısıyla sınırlıdır (şu anda 10). Bir dosya, kaç opsiyon içerirse içersin bir kez sayılır. Limitler her gün gece yarısı sıfırlanır.

Toplu veya otomatik indirmeler, bir dosyanın sürümlerinin sistematik olarak “toplanması” ve fiilen üzerinde çalıştığınız araçlarla ilgili olmayan her türlü kullanım yasaktır.

9. Eksik çözümler için talepler

Otomatik bir çözüm mevcut değilse, uygulamadan ücretsiz olarak bir talep gönderebilirsiniz. Bir talebin (ticket) işlenmesi 24 saate kadar sürer. Her durumda bir çözüm oluşturulabileceğine ilişkin herhangi bir hak talebi bulunmamaktadır. Çözüm eklendiğinde bilgilendirilirsiniz; ardından orijinal dosyanızı tekrar yükler ve dosyayı her zamanki gibi uygulamada alırsınız (tuning dosyaları kredi ile).

10. Map editörü, A2L ve map paketleri

Map editöründe görüntüleme ve düzenleme ücretsizdir. Map’ler yalnızca kendi A2L dosyanızla veya dosyanızın yazılımına ait bir M-BYTE map paketiyle gösterilir. Düzenlenmiş bir dosyayı yeni bir sürüm olarak kaydettiğinizde, uygulamada gösterilen fiyat (şu anda 2 kredi) onayınızdan sonra yazılım sürümü başına bir kez tahsil edilir; aynı yazılım sürümü için sonraki kayıtlar ücretsizdir. A2L uymuyorsa veya map paketi yoksa ücret alınmaz.

A2L dosyanız yalnızca bilgisayarınızda okunur ve yüklenmez. Uygun bir A2L kullanarak, M-BYTE’ın yalnızca bundan türetilen önemli map’leri (konum, boyut, dönüşüm ve birim – A2L’nin adları ve metinleri olmadan, M-BYTE’ın kendi adlarıyla) bu yazılım sürümü için bir map paketi olarak saklamasını ve diğer müşterilere sunmasını kabul etmiş olursunuz. Yalnızca kullanma hakkına sahip olduğunuz A2L dosyalarını kullanın.

Map editöründe yapılan değişiklikler sizin sorumluluğunuzdadır. Düzenlenmiş dosyaların doğru çalışacağına veya trafikte kullanım için izinli olduğuna dair hiçbir garanti vermeyiz; checksum’lar yazma sırasında flash cihazınız tarafından düzeltilir.

11. Lisans ve yasaklanan eylemler

Aboneliğiniz süresince yazılımı tek bir bilgisayarda kullanmak için basit, münhasır olmayan, devredilemez bir lisans alırsınız. Yazılım, çözüm veritabanı ve tüm içerik bizim veya lisans verenlerimizin mülkiyetinde kalır.

Özellikle şunlar yasaktır: lisans anahtarını veya hesabı başkasına vermek, satmak veya paylaşmak; uygulamayı uzaktan erişim yazılımı (ör. TeamViewer, AnyDesk) üzerinden kullanmak – uzaktan erişim tespit edilir; yazılımı veya lisans ve limit kontrollerini kaynak koda dönüştürmek, değiştirmek, kırmak (crack) veya atlatmak; M-BYTE ile oluşturulan dosyaları veya çözüm veritabanını üçüncü kişilere yeniden satmak.

İhlal durumunda lisansı derhal askıya alabilir veya engelleyebiliriz (bkz. “Askıya alma ve fesih”).

12. Hukuka uygun kullanım ve sorumluluk

Motor ve şanzıman beyinlerinde yapılan değişiklikler, özellikle DPF, EGR, AdBlue/SCR, NOx, lambda, DTC off ve performans artışları; emisyonları, tip onayını, tescili, sigortayı ve garantiyi etkileyebilir.

Dosyaların hukuka uygun kullanımından, ülkenizdeki tüm yasalara uyulmasından ve son müşterilerinizin bilgilendirilmesinden yalnızca siz sorumlusunuz. Orijinal dosyanın her zaman bir yedeğini saklamanız, her dosyayı yazmadan önce kontrol etmeniz ve kontrol ünitelerini okumak ve yazmak için gerekli mesleki bilgiye ve uygun cihazlara sahip olmanız gerekir.

13. Onayınız: hukuki sonuçlar

Bu Koşulları kabul ederek, motor ve şanzıman beyinlerinde değişiklik yapmanın hukuki, teknik ve sigorta açısından sonuçlarının farkında olduğunuzu onaylarsınız – özellikle tescil, tip onayı ve işletme izni, emisyon ve araç muayeneleri, sigorta teminatı, üretici garantisi ile motor ve aktarma organlarının aşınması ve kullanım ömrü bakımından – ve bu sonuçlara yalnızca sizin katlandığınızı onaylarsınız.

Bunu ayrıca kayıt sırasında ve her satın alma işleminde bir onay kutusuyla da onaylarsınız. Onay, bu Koşulların sürümüyle birlikte saklanır.

14. İşlev garantisi yoktur

M-BYTE ile oluşturulan dosyalar (veritabanındaki çözümler, map editöründe değiştirilen dosyalar, taleplerden gelen dosyalar) “olduğu gibi” sunulur. Bir dosyanın belirli bir araçta çalışacağına, belirli bir performansa ulaşacağına veya arızasız davranacağına dair hiçbir garanti veya taahhüt vermeyiz. Bir dosyanın bir araca uygun olup olmadığı, diğerlerinin yanı sıra bilmediğimiz ve kontrol edemediğimiz donanıma, yazılım sürümüne, aracın durumuna ve kullanılan cihazlara bağlıdır.

Her dosyayı yazmadan önce kontrol edin, orijinal dosyayı saklayın ve dosyaları kendi riskinizle kullanın.

15. Sorumluluk

Hizmet “olduğu gibi” sunulur. Motorlarda, şanzımanlarda, kontrol ünitelerinde veya araçlarda meydana gelen hasarlardan, tescil, tip onayı, sigorta veya garanti kaybından, para cezalarından veya hukuki sonuçlardan ya da dosyaların üçüncü kişilerce kullanılmasından sorumlu değiliz.

Diğer tüm hususlarda sorumluluğumuz, zarar doğuran olaydan önceki 12 ay içinde bize ödediğiniz tutarla sınırlıdır. Bu sınırlamalar; kasten veya ağır ihmalle verilen zararlar, hayata, vücuda veya sağlığa yönelik zararlar ya da sorumluluğun kanunen zorunlu olduğu durumlar için geçerli değildir.

Hizmeti hukuka aykırı kullanımınızdan doğan üçüncü kişilerin tüm taleplerine karşı bizi tazmin edersiniz.

16. Askıya alma ve fesih

Bu Koşulların ihlali halinde (ör. anahtar paylaşımı, uzaktan erişim, toplama, dolandırıcılık, ters ibraz (chargeback), hukuka aykırı kullanım) hesabınızı önceden bildirimde bulunmaksızın askıya alabilir veya feshedebiliriz. Bu durumda ödenmiş ücretler ve krediler iade edilmez.

Bizimle iletişime geçerek hesabınızı istediğiniz zaman sonlandırabilirsiniz; devam eden abonelikler önce hesaptan iptal edilmelidir. Kalan krediler hesabın silinmesiyle birlikte geçerliliğini yitirir.

17. Fiyatlar, faturalar ve vergiler

Tüm fiyatlar euro cinsindendir ve nihai fiyatlardır. Alpha International Software Development LLC, Gürcistan’da faaliyet gösteren bir şirkettir; faturalar KDV’siz olarak elektronik ortamda düzenlenir ve müşteri hesabında kullanıma sunulur. Ülkenizdeki vergilerden, ithalat KDV’sinden veya sorumlu sıfatıyla beyan (reverse charge) yükümlülüklerinden siz sorumlusunuz.

18. Gizlilik politikası

İşlediğimiz veriler: hesap ve fatura verileri (ad, adres, e-posta), lisans anahtarı, bilgisayar kimliği ve bilgisayar sayısı, IP adresi ve buradan belirlenen ülke, giriş ve etkinlik kaydı (ör. yüklemeler, indirmeler, satın almalar, talepler), bilgisayarda çalışan uzaktan erişim yazılımlarına ilişkin bilgiler, yüklenen orijinal dosyalar ve oluşturulan dosyalar, kredi ve ödeme geçmişi ile destek ekibimize gönderilen mesajlar.

Amaçlar: Hizmetin ve lisansın sağlanması, faturalandırma, kötüye kullanımın önlenmesi (anahtar paylaşımı, uzaktan erişim, sahte hesaplar), güvenlik ve destek. Hukuki dayanaklar sözleşmenin ifası, yasal yükümlülükler ve Hizmeti koruma konusundaki meşru menfaatimizdir.

Saklama: yüklenen dosyalar, bir talebin parçası olmadıkça yaklaşık 2 gün sonra otomatik olarak silinir; etkinlik kaydı 12 aya kadar saklanır; onaylanmamış kayıtlar birkaç gün sonra silinir; faturalar kanunun gerektirdiği şekilde saklanır; hesap verileri hesap silinene kadar saklanır.

Alıcılar: Bank of Georgia (ödemeler – kart verilerinizi asla görmeyiz veya saklamayız), barındırma sağlayıcımız (Hetzner, Almanya), Cloudflare (ağ koruması ve içerik dağıtımı) ve e-posta sağlayıcımız. Kişisel verileri satmayız.

Çerezler: yalnızca teknik olarak gerekli çerezler (oturum açma, güvenlik). Müşteri alanında veya uygulamada izleme ya da reklam çerezi kullanılmaz.

Erişim, düzeltme, silme, kısıtlama, veri taşınabilirliği ve itiraz haklarına ve bir denetim makamına şikâyette bulunma hakkına sahipsiniz. İletişim: info@m-byte.com.

19. Bu Koşullarda yapılacak değişiklikler

Bu Koşulları ileriye yönelik olarak değiştirebiliriz. Sizi e-posta ile veya müşteri hesabında bilgilendiririz. Devam eden abonelikler için yeni Koşullar bir sonraki yenilemeden itibaren geçerlidir; kabul etmiyorsanız öncesinde iptal edebilirsiniz. Her satın alma işleminde güncel sürümü kabul etmiş olursunuz.

20. Uygulanacak hukuk, yetkili mahkeme ve son hükümler

Gürcistan hukuku uygulanır. Tüketiciler için, mutad meskenlerinin bulunduğu ülkenin emredici tüketici koruma hükümleri saklıdır. Ticari müşteriler için yetkili mahkeme Tiflis, Gürcistan’dır.

Bazı hükümlerin geçersiz olması halinde, geri kalan hükümlerin geçerliliği etkilenmez.
